Na RiseUp je policejní internacionála krátká
V anarchistickém prostředí je v oblibě e-mailová komunikace přes riseup.net, protože tato platforma zaručuje anonymitu a odmítá spolupráci s policií, soudy atd. Často se vedou debaty o tom, zda se můžeme na tuto záruku opravdu spolehnout. Vystává mnoho otázek. Kauza Fénix naštěstí na některé dokázala odpovědět. Přinesla třeba několik příkladů, že policie vážně nedokáže RiseUp.net prolomit a získat citlivé údaje o lidech, kteří využívají jejich služeb.
Platformu RiseUp.net ve svém článku kdysi představil Jan Hanuš. V drobných detailech je možná již neaktuální, ale v tom zásadním stále platný. Podívejme se ale nyní jak o RiseUp.net píše policie ve spisech kauzy Fénix.
Policie vyšetřuje několik případů při kterých byly použity e-maily založené na riseup.net. Jedná se o desítky schránek. Ani v jediném případě se jí nepodařilo odhalit identitu uživatelů, ani získat přístup k jejich obsahu. Nutno zdůraznit, že na RiseUp.net není krátká je česká policie. Marné jsou i útoky “policejní internacionály.” Myšlena je spolupráce české policie s jejich kolegy z jiných zemí.
Policie od roku 2014 vyšetřuje, kdo odesal komuniké Sítě revolučních buněk. K tomu v jednom ze svých úředních záznamů uvádí:
K odeslání byly použity e-maily ze serveru riseup.net. Server a poštovní služby jsou určeny zejména pro aktivisty z řad anarchistického, antiautoritářského, antifašistického a radikálně-environmentálního hnutí. Je znám pro důraz kladený na anonymitu uživatelů zejména v tom ohledu, že nejsou archivována data, především historie přístupů a obsahu schránky, není limitováno využití různých anonymizačních prostředků, např. TOR serverů a zároveň hlavička e-mailu je po odeslání serverem upravena tak tak, aby zobrazovala IP adresu odesílatele jako tzv. localhost a zabránila tak identifikaci odesílatele.
Zřejmě z toho důvodu byly e-mailové schránky serveru Riseup.net využity v celkem 45 případech od 28. 12. 2015 k anonymním oznámením o umístění nástražných výbušných systémů v restauraci Řízkárna. Série anonymních oznámení představuje tzv. druhou vlnu kampaně útoků proti restauraci a zaštituje ji tzv. Síť revolučních buněk. Cílem uvedených oznámení je omezit chod restaurace prostřednictvím evakuace a dále snižovat její pověst či oblíbenost, negativně ovlivnit klientelu a tím způsobovat obecně jak přímé, tak nepřímé škody.
Takto o RiseUp.net píší policejní vyšetřovatelé Václav Bartoš a Martin Janků. Vpodstatě tak vlastními slovy opakují, co správci RiseuUp.net deklarují na internetu. Dále navíc potvrzují, že nejsou schopni vyšetřováním získat, co by rádi. Jejich bezradnost potvrzují i další policisté jako třeba vrchní komisaři Jaroslav Renda a Milan Kavka. Citujme zde část z jejich úředních záznamů.
Provozovatel riseup.net poskytuje e-mailové služby, chat služby a službu sdílení dat a uložitě dat. Smyslem poskytovaných služeb na tomto serveru je jejich anonymyzování, neboli naprostá nezjištitelnost osob, které za jednotlivími komunikačními prostředky stojí. S ohledem na všechny víše uvedené skutečnosti lze uvést, že komunikace probíhající přes systém “riseup.net” je pro orgány činné v trestním řízení zcela nedostupná. Žádné informace od uvedeného provozovatele nelze získat cestou mezinárodní policejní spolupráce ani cestou právní pomoci za užití ustanovení trestního řádu. Získání jakýchkoli informací vylučuje již sám účel, za jakým byl předmětný komunikační prostředek vytvořen.
Co k tomu dodat? Možná jen to, že ikdyž kauza Fénix nepříjemně zasáhla část anarchistického hnutí, zárověň se ukazuje, že nám dala i něco pozitivního. Zejména pak důležité informace o tom, co pro nás je či není bezpečné nebo co je či není vhodné používat. Platforma riseup.net zatím ve střetu s Fénixem obstála a to je velmi potěšující skutečnost. Mýtus všemocné policiie byl tak zase pořádně zpochybněn. Jen tak dál!
Policie dokáže mnoho, ale nedokáže vše. Každé gesto povstání tedy v sobě nese naději na výtězný boj. Proto bojujme a používejme riseup.net i další vhodné nástroje v rámci bezpečnostní kultury.
